Prior to 1975, parents of students with disabilities had little to no resources to ensure that their children received educational opportunities provided to non-disabled children. In 1975, Congress passed the Individuals with Disabilities Education Act (IDEA), which enabled all children, regardless of their mental, physical, or emotional disabilities, access to free and suitable education.

Over time, provisions of the 1975 act needed to be updated to meet the needs of current disabled students. As a result, IDEA was reauthorized in 2004 to include provisions that addressed the disbursement of medication, evaluations, and individualized education plans (IEP). The updated act also implemented changes for procedural safeguards, parental rights, and discipline for special education students.

The current act includes several significant provisions regarding parents and school personnel. Under the current act, school personnel cannot require parents to obtain prescription medications to allow children to attend school, parents have the right to refuse the initiation of special education services, and parents can file a request for a due process hearing. Additionally, procedural safeguard statements must be provided to parents once a year and students who are removed from current placement for behavior issues must continue to receive appropriate services.
