Texas State Board of Education Lawsuit

The first paper will be a critical analysis of Dr Daniel D. Chiras' lawsuit against Texas State Board of Education.

In the Texas State Board of Education Lawsuit Research Paper, the student will be responsible for:

1. Reading and summarizing the plaintiffs' briefs before both the US District Court and the Fifth Circuit of Appeals;
2. Reading and summarizing the decisions of both of these two federal courts;
3. Including the titles, authors, sources, dates, and specific urls of 15 commentaries( including different blog sites and posting boards) on the lawsuit (five of these commentaries must be pro-defendant, and five must be obviously neutral);
4. Commenting- on the basis of having read the briefs, the two court decisions, and the public commentaries, and avoiding bias and preconceived notions on the matter other than your personal knowledge of the author's philosophy on education and writing style - on his or her personal observations on the validity of the lawsuit, whether Dr Chiras' claims against the Texas State Board of Education were justified and whether the decisions of both courts were correct.

Summary of The Minutes of the Board of Education

The student should first read the "minutes, state board of education", November 9, 2001 pp4-10 a copy which will be provided.

For the summary of plaintiffs' briefs (complaints) before the US district Court, the three briefs must first be read, and then summarized. This Texas State Board of Education Lawsuit must be at least one and a half page in length, with maximum of three pages. Each of the three Plaintiffs' Briefs must be summarized in a separate paragraph. All the plaintiffs and defendants must be identified in an introductory paragraph.

The summary of Plaintiffs' briefs (complaints) before the U.S Appellate Court must be accorded the same attention given above for the US Distinct Court briefs. In the summary of Plaintiff's Briefs (Complaints) before the US appellate court, the three briefs must first be read, and then summarized. This Texas State Board of Education Lawsuit must be at least one and a half pages in length, with a maximum of three pages. Each of the three Plaintiff's Briefs must be summarized in a separate paragraph. All the plaintiffs and defendants must be identified in an introductory paragraph. Please be sure to identify all additional ancillary organizations that joined the plaintiffs' cause for the appeal as amici curiae.

The summaries of both the district court and appellate court decisions must each be a minimum of one complete page and a maximum of one complete page and a maximum of two pages in length. It is imperative that the major points of difference between the decisions of the two federal courts be included in the two summaries. Even thought both courts found for the defendants they did so for different reasons. Failure to include those different reasons in the summaries will results in a deduction of five points for each summary.
